AI Governance in UK Law Firms: Why Compliance Officers Need Better Support in 2026

The SRA's December 2025 thematic review examined 25 firms and interviewed 36 professionals. Findings illustrated a familiar challenge: compliance professionals manage increasingly complex regulatory landscapes with identical resources from five years prior.

At most mid-size firms, the COLP functions as both compliance officer and practicing solicitor. They handle regulatory obligations alongside full caseloads, serve on management committees, manage complaints, maintain risk registers, handle SRA reporting, oversee AML compliance, address data protection, and manage professional indemnity renewals. AI governance landed atop this existing pile, with nothing removed to accommodate it.

This significant responsibility falls to professionals who often lack formal AI governance training, dedicated budgets, or purpose-designed tools.

Compliance officers recognize AI governance's importance. The question remains whether they receive necessary support.


AI Is New for Everyone

Generative AI in legal practice remains relatively new. Widespread adoption across UK mid-size firms occurred in 2024, with acceleration through 2025. Regulatory frameworks continue evolving. The SRA is preparing a GenAI FAQ document and Good Practice Note on AI use and client data — neither yet published. A February 2026 webinar on AI Policy and Regulation demonstrates the regulator itself is navigating this terrain contemporaneously.

When regulators are still developing guidance, expecting every compliance officer to maintain complete governance frameworks is unreasonable. What matters is trajectory: firms taking this seriously and building toward robust structures.

The Three Areas the SRA Is Watching

Full guidance remains forthcoming, but the SRA has identified pressing risk categories for AI tool adoption.

Confidentiality and Data Handling

When lawyers employ AI tools, data travels to various locations. Is client information processed offshore? Could it enter training datasets? Vendor answers vary substantially. Some provide on-premise deployment and UK-based data centers; others operate entirely in the cloud with limited data flow transparency. Obtaining clarity requires navigating complex vendor terms not written for COLPs.

Competence and Output Verification

AI-generated legal research and drafting contain errors, including plausible-sounding inaccuracies difficult to identify without careful review. The SRA expects firms using AI tools maintain clear human verification protocols for AI outputs. This preserves the care standard clients deserve.

Supervision, Especially for Junior Lawyers

Junior lawyers and trainees represent the heaviest AI users — understandable given these tools amplify productivity for earlier-career professionals. However, this creates a supervision challenge: who ensures trainee AI-assisted work meets equivalent standards as traditionally produced work? Supervision frameworks require evolution, and compliance officers need practical implementation guidance.


What a Right-Sized Governance Framework Looks Like

Most existing AI governance frameworks target large enterprises or magic circle firms with dedicated innovation teams and six-figure technology budgets. This doesn't reflect typical UK mid-size firm reality.

A governance framework needn't be a 60-page policy document. For 50-200 person firms, it requires practicality, maintainability, and proportional risk assessment. Based on SRA signals and compliance professional feedback, effective frameworks address five components:

1. AI Register

Maintain a simple record identifying which AI tools the firm uses, who uses them, what data they process, and where that data resides. This foundation is essential — governance cannot address unmapped tools.

2. Acceptable Use Policy

Establish clear guidance on which work types permit AI use, which client data inputs suit which tools, and what disclosure obligations exist. Write in language lawyers actually read, avoiding downloaded internet templates.

3. Output Verification Protocol

Define a process reviewing AI-generated work before client delivery. This needn't create bureaucratic bottlenecks — it requires establishing habits. Document who reviews what, at which stages, and what gets documented.

4. Training Requirements

Implement ongoing programs — not one-time webinars — ensuring everyone using AI tools understands capabilities and limitations. Compliance officers themselves need training on both technology and regulatory expectations.

5. Incident Response Plan

Plan for problems. When AI tools produce incorrect legal analysis reaching clients, or data handling breaches occur, who responds and how? Pre-documented procedures prevent crises.

This requires no dedicated AI team. It requires compliance officers with appropriate support, correct tools, and sufficient time.


The August 2026 Deadline Adds Urgency

The EU AI Act enforcement begins August 2026 — four months away. Though European legislation, its extraterritorial scope affects UK firms advising clients with EU operations, contracts, or customers. This accompanies the SRA's evolving expectations and the broader industry shift toward formalized AI policies. Gartner projects 80% of enterprises will deploy GenAI-enabled applications by 2026, yet most still lack formalized governance.

For already-stretched compliance officers, this timing creates genuine pressure. Firms acting now — even with imperfect initial frameworks — will occupy stronger positions than those awaiting perfect guidance potentially unavailable before deadlines arrive.


Support, Not Blame

The legal profession embraced AI adoption remarkably rapidly — positive development. These tools help lawyers serve clients better. But ungoverned adoption represents escalating risk. Compliance officers — ideally positioned to manage this risk — deserve superior support.

This means proper tooling, practical guidance, and continuous training. Firm leadership must recognize AI governance isn't peripheral work. It represents core function requiring appropriate resourcing.


A Question for Firm Leadership

If your firm represents the 93% using AI, consider: Has your COLP received dedicated time, budget, and proper tools for building an AI governance framework? Or has AI governance simply accumulated on an already-full plate with unstated assumptions they'll manage it?

If the latter applies, the shortfall isn't your compliance officer's knowledge or dedication. It's the support they've received.

Closing this gap before the SRA's next thematic review, before EU AI Act enforcement, before incidents force discussion, represents one of today's highest-value firm investments.
